Rules & Regulations

APPLICATION. I am applying for membership in the INNOVATIVE FITNESS CENTER located at 201 Locust Street Section E, Youngwood, Pa 15601 (the “Studio” or “Club”). I represent and warrant that I am 18 years of age or older and all facts and information set forth above and/or in the Membership Application dated this date (the “Application”) are true, correct and complete. The Application is incorporated by reference and made a part of this Contact. 

 

PAYMENT. a. Monthly Payment: I must pay the Total Due Today upon signing this Contract as selected above. Payment: $35 Initiation fee will be deducted. Reactivation fee: $35 at time of rejoining NSF: I will be charged $25 for any checks that do not process due to NSF. 

TERM. All memberships can be of three (3) months, from the date of the Start Date. Memberships will thereafter be automatically renewed at the current membership rate. By mutual agreement, one type of membership may be converted to another type of membership pursuant to a new contract with Innovative Fitness Center.

CANCELLATION. I (or my legal representative) may cancel this Contract without penalty. I understand there is no penalty for early cancellation of my membership. Memberships 2 days past due will not have access until paid and will be canceled if not paid within 10 days. Reinstatement requires payment of dues owed, reinstatement fee of $35 and payment of first month of new membership. Written notice of 30 days must be given to assure cancellation of memberships. No partial months.

FEE GUARANTEE. Membership fees may be modified from time-to-time by Innovative Fitness Center. However, no membership fee change will be applicable to me during the initial term of this Contract (but will be effective for any renewal periods). Closing of account, insufficient funds or any other action which prevents the automatic charge for my monthly dues, if applicable, will be a material breach of this Contract. Member agrees to pay reasonable attorney fees, legal expenses, and other lawful collection costs and expenses of collection incurred after a material breach of this Contract.

MEMBERSHIP FOBS. I will be issued a membership fob which will entitle me to enjoy the benefits of membership. I will present my membership fob for admittance and I will be responsible for the proper use of the fob. I will not permit anyone else to use my fob. If my fob is lost I will be required to purchase a replacement fob, and the old fob will be deactivated. Cost of $7.00 ($12.00 for each additional replacement card during the same term). Upon termination I will surrender|return my membership Fob(s) or be charged $7.00/fob not turned in. If you share your fob to allow entry to the gym, you agree to forfeit your right to your membership.

MEMBERSHIP PRIVILEGES. I will be admitted to the facility with use of the keyless fob according to my membership privileges. Access to after hours use is available for members that are 18 years of age and older. Under the age of 18 years of age will not be permitted to access the facility during off business hours. Not all programs, benefits, facilities, equipment, etc. will be available at all times. Children 12-14 must be with a parent during workout sessions.  Memberships are not assignable or transferable and any attempted transfer or assignment shall be null and void.

MEMBER’ S RESPONSIBILITY. All use of the fitness center shall be undertaken at my sole risk, and Innovative Fitness Center and/or its Owners, Manager, Staff, Trainers shall not be liable for any harm, injuries or damage to me or my property, or be subject to any claim, demand, liability or damages whatsoever, including, without limitation, those resulting from acts of active or passive negligence on the part of Fitness Center and/or its Owners, Manager, Staff, Trainers, its successors or assigns, as well as its officers and agents, for all such claims, demands, liabilities, damages, actions or causes of actions. It is specifically agreed that Fitness Center and/or its Owners, Manager, Staff, Trainers shall not be responsible or liable for articles lost, damaged or stolen in, about or in connection with the Fitness Center nor for loss or damage to any other of my property, including automobiles and contents. It is also agreed that any damages to Fitness Center and/or its Owners, Manager, Staff, Trainers, or the Club or its contents, or property or the property of any member by another member is the sole responsibility of the offending member. The foregoing notwithstanding, neither Innovative Fitness Center and/or its Owners, Manager, Staff, Trainers shall be relieved by this Paragraph from liability for its own gross negligence and/or willful misconduct.

RULES AND REGULATIONS.I acknowledge that Innovative Fitness Center operates under rules and regulations established for the safety, comfort and protection of members or other patrons and I will abide by and be bound by all posted rules and regulations, as well as by rules and regulations subsequently approved and posted or published by Innovative Fitness Center and/or its Owners, Manager, Staff, Trainers. Rules and regulations of Innovative Fitness Center, in effect from time-to-time, are incorporated into this Contract by reference and made a part hereof. Facilities, equipment, amenities, hours, service, regulations, and policies are subject to change, without prior notice, at the sole discretion of Innovative Fitness Center and/or its Owners, Manager, Staff, Trainers , and I accept such reasonable changes as a condition of membership. After Hours access is only available to members and must be 18 years or older. For your safety, please follow recommended guidelines. Any misconduct will result in termination of the membership. Be advised video surveillance cameras are located in and around the facility.

BATHROOM RULES: MEN ARE NOT PERMITTED IN THE WOMANS BATHROOMS- AND WOMEN ARE NOT PERMITTED IN THE MENS BATHROOM! Immediate termination of your membership if these rules are not respected or followed. Harassment of any kind WILL NOT be tolerated. Definition is as followed, The differences between males and females are the X and Y chromosomes. Among humans, two X chromosomes make a woman, and an X and a Y chromosome make a man. No Cats, Dogs, or “other” are permitted to join.

TANNING | SAUNA. It is our intention to keep you as well informed about tanning as possible. The proper procedure to follow in the tanning | sauna room will be clearly explained by a member of our staff. Please feel free to ask any questions. I have read the contents of this consent form carefully and state that I am not aware of any medical condition or other reason that would prohibit me from either the sauna bed or from tanning. I understand that I will not be allowed to exceed the maximum allowable time posted on the tanning device. I have been given adequate instructions for the proper use of the Sauna | Tanning equipment, understand the risks involved, and use it at my own risk. I hereby agree to release the owners, operators and manufacturers from any damages that I might incur due to the use of this facility. You Must be at least 18 years old to Tan.

GENERAL PROVISIONS. I acknowledge I have inspected the Club and the same is in full operation. No promises, representations or warranties have been made to me by Innovative Fitness Center or otherwise about the Club. I acknowledge and agree that the Initiation Fee represents a reasonable charge for initiating my membership considering the time and effort required of Innovative Fitness Center. I acknowledge that it has been explained to me that this is a legally binding and enforceable contract and that I have agreed to maintain my membership for the period of time specified. This Contract sets forth the entire agreement between me and Innovative Fitness Center regarding my membership and any and all prior discussions, agreements, understandings or correspondence are hereby made null and void. This Contract may be amended, modified or rescinded, or any rights hereunder waived, only by written agreement signed by me and Innovative Fitness Center. If any term or provision of this Contract is found to be invalid, illegal or unenforceable, in whole or in part, the rest and remainder of this Contract shall remain in full force and effect to the fullest extent permitted by law. Testimonial and Photo Release: In consideration of good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I, the undersigned, hereby grant to Innovative Fitness Center, owner, manager, staff, trainer, the right to use my photographs, images, story and/or testimonial, in whole or in part, and without restriction as to changes or alterations. The rights granted herein shall extend in perpetuity, unless revoked in writing to Trainer by me, throughout the world and for any purpose whatsoever, including without limitation for marketing and advertising purposes of Trainer, and in any and all media, including without limitation Innovative Fitness Center or the Trainer’s website. I acknowledge that Innovative Fitness Center nor theTrainer has no obligation to return any photographs or images to me. “I understand that I am responsible for all reasonable collection fees, court costs and attorney fees associated with any unpaid balances due according to this Contract.” 

 

We hereby agree to all terms of this Contract, intending to be legally bound hereby, complete executed copy of this Contract will be on file. Accepted by Innovative Fitness Center L.L.C.
